Terms of Service

These Terms of Service (“Terms”) govern access to VibeMail, the website at https://www.vibemail.dev, and related services. By creating an account or using the product, you agree to these Terms and our Privacy Policy.

VibeMail is an AI-assisted tool for drafting, previewing, versioning, and exporting email templates (including HTML, MJML, and React Email). Features, models, and credit costs may change as we improve the product.

You must provide accurate information and keep your login credentials secure. You are responsible for activity on your account. You must be at least 13 years old, and old enough to form a binding contract where you live.

You own the prompts, templates, and other materials you create in VibeMail (“Your Content”). You grant us a limited license to host, process, display, and generate derivatives of Your Content solely to operate and improve the service (for example, compiling a preview or sending a test email you request).

You represent that you have the rights needed to use Your Content in the product, including any copy, images, or brand assets you upload or generate.

Generated emails and code are probabilistic. They may be inaccurate, incomplete, or similar to content produced for others. You are responsible for reviewing output before you send it to anyone. VibeMail does not guarantee that generated content is unique, legally compliant, or fit for a particular campaign.

You may not use VibeMail to:

• Send spam, phishing, or unsolicited bulk email
• Violate email, privacy, advertising, or anti-spam laws
• Infringe others’ intellectual property or privacy rights
• Attempt to disrupt, reverse engineer, or overload the service
• Circumvent credit metering, plan limits, or security controls
• Generate malware, exploits, or content that is illegal where you use the service

We may suspend or terminate accounts that violate these rules.

Paid plans, credit allowances, and top-ups are described on the pricing page. Credits are consumed based on actual model usage. Unused monthly credits typically expire at the end of the billing period; purchased top-up credits are described in the product.

Subscriptions renew automatically until you cancel through the billing portal or by contacting support. Fees are charged by Stripe in US dollars unless stated otherwise. Except where required by law, payments are non-refundable, including unused credits.

Free and some paid plans may include a small “Made with VibeMail” notice on emails sent through our test-send feature. Removing that notice, where offered, is a plan perk described in the product.

The product relies on third parties (including Supabase, Stripe, Vercel, Resend, OpenAI, Anthropic, and Google if you use Google sign-in). Their terms and privacy policies apply to their processing. An outage or change on their side may affect VibeMail.

You may stop using VibeMail and request account deletion at any time. We may suspend or close accounts for violation of these Terms, non-payment, or if we discontinue the service. Upon termination, your right to use VibeMail ends. We may delete Your Content after a reasonable period unless we must retain it for legal or billing reasons.

VibeMail is provided “as is” and “as available.” We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law. We do not warrant that the service will be uninterrupted, error-free, or that emails will render correctly in every inbox.

To the fullest extent permitted by law, VibeMail and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or replacement costs. Our total liability for any claim relating to the service is limited to the amounts you paid us in the three months before the claim, or $50 if you have not paid us.

You will defend and indemnify VibeMail against claims arising from Your Content, your emails, or your misuse of the service.

We may update these Terms. The “Last updated” date will change when we do. If a change is material, we may provide additional notice (for example by email or in the product). Continued use after the update means you accept the new Terms.
